A Hatboro man accused of shoplifting nearly high-end merchandise twice in one night at Best Buy in Montgomeryville has been accepted into a special Montgomery County Court probationary program that allows eligible defendants to have criminal records expunged upon completion.

Jason M. Voytko, 38, of the 600 block of Delft Lane, was approved for the program for 18 months earlier this month by Montgomery County Common Pleas Judge Risa Vetri Ferman, according to court records.

He was charged in September 2025 for alleged offenses that occurred at the Montgomery Township store on Bethlehem Pike on June 11, 2025.

If Voytko completes all program requirements, then the underlying criminal charges are dismissed, and he is eligible to have the records expunged.

Per terms of the ARD agreement – which applies to four felonies, including two counts each of receiving stolen property and retail theft – Voytko must also perform 24 hours of community service and repay $4,059 to Best Buy. Voytko is also banned from Best Buy stores. A misdemeanor DUI charge was dismissed.

According to the criminal complaint, store surveillance footage showed a man — later identified as Voytko — entering the store around 6:58 p.m. and placing a KitchenAid Artisan mixer and a 27-inch LG monitor into a shopping cart. Police said Voytko exited the store four minutes later without paying for the items and loaded them into a black 2005 Acura TL.

But the theft did not end there.

Police said Voytko then returned the cart to the store, re-entered around 7:05 p.m., and selected a second KitchenAid mixer and another LG monitor. Once again, he exited the store without paying and loaded the items into the same vehicle before leaving the parking lot, according to the complaint.

Montgomery Township Police were contacted about the theft on June 23 after a store employee discovered the incident during a review of surveillance footage. The merchandise had not been recovered, police said.
