A Souderton man accused of fighting with borough police during a traffic stop on an icy roadway last month had two of 10 charges withdrawn at his preliminary hearing, though the most serious count was held for court.
Jonathan James Timms, 42, of the 300 block of North Main Street, had one of two aggravated assault charges withdrawn, along with one misdemeanor simple assault count, according to court records.
The remaining aggravated assault charge — alleging he placed an officer in fear of imminent serious bodily injury — was waived for Montgomery County Court of Common Pleas, along with misdemeanor counts of simple assault (one count), recklessly endangering another person, resisting arrest, and two counts of disorderly conduct. A summary harassment charge and driving while license suspended or revoked were also waived.
The charges stem from a Jan. 23, 2026 traffic stop around 5:27 p.m. along North Main Street, where Souderton Borough Police said an officer observed Timms operating a black 2010 Toyota Tundra despite having a suspended license.
According to the criminal complaint, the vehicle made several quick turns before stopping near 320 North Main Street on what officers described as an icy incline. Police said the truck had difficulty climbing the hill before coming to a stop.
Officers alleged Timms refused repeated commands to exit the vehicle. Police further stated an officer observed a red Milwaukee-brand pocketknife on Timms’ leg and attempted to secure it.
“When I reached for it, he struck me in the chest with his left hand. I reached inside of the vehicle with both hands, removed him from the vehicle and put him on the ground outside of the vehicle,” police wrote in the affidavit.
Authorities said Timms continued to resist while on the ground and still in possession of the knife before being subdued and handcuffed. Police noted the surface was icy and snow-covered, with stones and concrete nearby.
One assisting officer suffered a laceration and abrasion to his knee that appeared to require medical attention, according to police. The primary officer reported minor cuts and abrasions to his hands and knees.
Timms is free on $5,000 cash bail and is represented by a public defender. A formal arraignment is scheduled for April 1 in Common Pleas Court.
