According to the Second Class Township Code, supervisors must accept the resignation in a majority vote.
Towamencin Township Board of Supervisors have selected Tuesday, Feb. 4 at 6 p.m. for the special meeting to consider accepting the resignation of Republican Supervisor Laura Smith.
The meeting will be held at the meeting hall at the township municipal complex at 1090 Troxel Road.
While Smith, who tendered her resignation after a Tik Tok video went viral across social media of her imitating an anti-Semitic salute, immediately resigned Sunday afternoon, it is not official until accepted by a majority vote of the supervisors, according to the Second-Class Township code in Pennsylvania.
The current supervisors board consists of two Republicans, Chairman Chuck Wilson and Kristin Warner, and two Democrats, Kofi Osei and Joyce Snyder.
Once accepting the resignation, the board must appoint, in 30 days, a registered elector to fulfill the remainder of Smith's term, which ends this December.
According to Second Class Township code in Pennsylvania, if the supervisors refuse, fail, neglect or are unable to fill the vacancy of Smith 30 days from her resignation, then a Vacancy Board is formed to fill the position within an additional 15 days.
The Vacancy Board would be comprised of the Board of Supervisors and one registered elector of the township, appointed by the supervisors, per the code. The appointed elector shall act as the chairperson of the vacancy board.
If the vacancy board fails to fill the position within 15 days, the chairperson, or if the position of the chairperson is vacant, the remaining members of the vacancy board, shall petition the Montgomery County Court of Common Pleas, to fill the vacancy, per the code.
Smith's appointed successor would hold office until the first Monday in January after the first municipal election.
