Form I-539 Instructions: How to Request an Extension or Change of Nonimmigrant Status

In accordance with U.S. immigration law, all nonimmigrant visas are issued for a temporary time period; however, certain categories may allow for extensions or changes of nonimmigrant status. I-539 Instructions

Form I-539, Application to Extend/Change Nonimmigrant Status, is a form utilized by United States Citizenship and Immigration Services (USCIS) to process extension or change of nonimmigrant status applications.


The form consists of the following eight parts that are both required and optional:


Part 1: Information About You (required)

Part 2: Application Type (required)

Part 3: Processing Information (required)

Part 4: Additional Information About the Applicant (required)

Part 5: Applicant’s Statement, Contact Information, Declaration, Certification, and Signature (required)

Part 6: Interpreter’s Contact Information, Statement, Certification, and Signature (optional)

Part 7: Contact Information, Declaration, and Signature of Preparer (optional)

Part 8: Additional Information (optional extra space, if needed)


You must use the most current version of the form. A PDF file is available to download on the official USCIS Form I-539 webpage. All required parts must be filled out either by typing or legibly handwriting in black ink. Once completed, the I-539 may be filed online or mailed to the appropriate USCIS filing address.

How to Request a Copy of My Immigration File Through USCIS FOIA

It may be helpful to request your immigration file when applying for an extension or change of nonimmigrant status, and The Freedom of Information Act (FOIA) allows you to do so. To make a USCIS FOIA request, follow these four steps:


  1. Log in to or create an online USCIS account.
  2. Initiate your request.
  3. Provide information about your specific request.
  4. Submit your request and use the control number received in a confirmation email to track the status of your request.

A USCIS Online Access Code is a unique 14-character identifier that is included on the Account Access Notice that USCIS mails to all immigration applicants. The code grants exclusive access to various USCIS online account features, allows secure storing of active petitions and applications, tracks petition and application statuses, and provides important updates related to specific immigration cases and general immigration news.
