A South Carolina man has been sentenced to probation for entering a random home in North Wales Borough last year and allegedly passing out drunk on a couch.
Frank Lucas, 42, of Blackville, pleaded guilty on Feb. 20 to one misdemeanor count of defiant trespassing, and was sentenced to six months’ probation, court records show. An additional summary count of public drunkenness was dropped as part of the plea agreement, and the more serious felony count of criminal trespassing was withdrawn during his preliminary hearing last year.
Lucas was ordered to undergo drug and alcohol treatment as part of his sentence, and he is prohibited from going near the victim’s home, court records show.
Police were dispatched to a home on West Montgomery Avenue on Feb. 3, 2023 for a report of an unknown person inside of the residence. Upon arrival, police met with a resident who took them inside of the home and led them to Lucas, who was passed out drunk on a couch in the living room, according to charging documents.
The resident said they were asleep with their wife and two young children when they awoke to find Lucas on the couch, the report states. The resident also said they had never seen or met Lucas before, and he had no permission to be inside the home, according to the criminal complaint.
Police woke up Lucas and asked him if he knew where he was, to which he allegedly replied, "I am home.” Lucas then remained on the couch and made no attempt to leave the home, police said.
Lucas was described by police as smelling of alcohol and having bloodshot, glassy eyes, slurred speech, and slow movements. A portable breath test allegedly showed he had a blood-alcohol content of .21% at the time of the incident, according to the criminal complaint.
As a result of the incident, Lucas was taken into custody.
