A Towamencin man who pleaded guilty to DUI in February 2023 was recently arrested again on his fourth set of DUI charges since August 2023.
Mohammad Jayed Khan, 33, was arraigned on Jan. 10 on a pair of misdemeanor DUI charges stemming from an incident that occurred in Hatfield Township on Nov. 8, 2023. Khan now has four active DUI cases against him in Montgomery County, court records show.
According to criminal complaint, Hatfield Police were dispatched to the intersection of Orvilla and Welsh roads at 4:59 p.m. for a report of an unconscious male in a white Honda. Arriving police located Khan unconscious in the driver’s seat with his vehicle in drive, at which point they were able to unlock the door and place the vehicle in park, the report states.
Khan did not initially respond to a sternum rub, however he awoke a short time later, stared at police, and said "Hey,” police said. Khan reportedly had a strong odor of alcohol, but when asked how much he had to drink, he replied "Not much,” according to police.
Investigators said Khan was unsteady on his feet and he failed a series of field sobriety tests. He later consented to a blood draw for testing, which revealed his blood-alcohol content to be .361% — more than four times the legal limit — according to charging documents.
At the time of his November arrest, Khan was out on bail for three other recent DUI arrests — all of which occurred in Towamencin Township between Aug. 2, 2023 and Sept. 21, 2023.
In the Aug. 2, 2023 arrest, Khan was charged with two misdemeanor counts of DUI following a vehicle crash in which his blood-alcohol content was .357%, police said. He was arrested again on Sept. 2, 2023, after police allegedly found him unconscious behind the wheel of a Nissan Murano in the middle of the intersection of Cheswold Drive and Troxel Road at 6:33 p.m. His blood test would later show his blood-alcohol content was .283% at the time of the incident, police said.
Khan was arrested again on Sept. 21, 2023, after police were dispatched to Forge Gate Apartments on Snyder Road for a report of an unconscious male inside of a vehicle. Investigators said they located Khan passed out in a parked Honda HRV that was running and had to apply a sternum rub to wake him up.
Court records show Khan pleaded guilty to misdemeanor DUI on Feb. 27, 2023, stemming from a September 2022 arrest for DUI in Lansdale Borough. Police said Khan’s blood-alcohol content in that case was .298%, however court records show he ultimately pleaded guilty to DUI: general impairment instead of DUI: highest BAC.
According to PennDOT, a first offense for general impairment carries a sentence of up to six months’ probation along with a $300 fine, attendance at alcohol highway safety school, and a drug and alcohol evaluation. There is no suspension of a driver’s license for first-time offenders of the lowest DUI charge, meaning Khan still had an active driver's license at the time of his four recent arrests.
Khan was arraigned on the new charges on Jan. 10 by Magisterial District Judge Henry Schireson. He is currently free on $5,000 unsecured bail, and his next court appearance in that case is a preliminary hearing on Jan. 31 at 2:30 p.m. in front of Magisterial District Judge Ed Levine.
Court records show Khan is awaiting court proceedings in the other three cases, and a hearing to modify bail following a motion by prosecutors has been scheduled for Feb. 7 at 10 a.m. in front of Montgomery County Common Pleas Judge Thomas Branca.
