A Towamencin man is facing felony charges after three DUI arrests in the last two months and a total of four DUI arrests in the last year.
Court records show three separate criminal cases were filed against 32-year-old Mohammad Jayed Khan last week for incidents on Aug. 2, Sept. 2, and Sept. 21 in Towamencin Township. In the Aug. 2 incident, Khan was charged with two misdemeanor counts of DUI – second offense following a vehicle crash in which his blood-alcohol content (BAC) was .357% — more than four times the legal limit in Pennsylvania, police said.
Khan was arrested again on Sept. 2 in Towamencin Township, after police allegedly found him passed out behind the wheel of a Nissan Murano in the middle of the intersection of Cheswold Drive and Troxel Road at 6:33 p.m. Police said Khan was unresponsive with delayed, shallow breathing, slumped over the steering wheel with the vehicle still in drive. After backing a police vehicle to the front of the Nissan, police had to break a window, administer Narcan, and apply a sternum rub to wake him up and place the vehicle in park, according to charging documents.
Investigators said Khan showed signs of impairment during field sobriety tests, and a blood analysis later revealed Khan had a blood-alcohol content of .283%.
Court records show Khan was arrested for the third time in seven weeks on Sept. 21, after police were dispatched to Forge Gate Apartments on Snyder Road for a report of an unconscious male inside of a vehicle. Investigators said they located Khan passed out in a parked Honda HRV that was running and had to apply a sternum rub to wake him up.
Khan denied that he had been drinking, but police said empty liquor bottles were visible inside of the vehicle and a strong odor of alcohol was emanating from his person, according to charging documents. Police said Khan failed a series of field sobriety tests, and he was subsequently taken into custody.
Investigators are awaiting the results of blood testing from the Sept. 21 incident.
Khan was arraigned on Sept. 22 on two felony DUI charges stemming from his Sept. 2 arrest and one felony DUI charge stemming from his Sept. 21 arrest. Magisterial District Judge Denise Ashe set bail at $2,500 unsecured in each of those cases, and Khan has a joint preliminary hearing on Oct. 18 at 10:15 a.m. in front of Magisterial District Judge Ed Levine.
The pair of misdemeanor DUI – second offense charges were sent to Khan via summons, and his first court appearance on those charges in a preliminary hearing on Oct. 11 at 11:45 a.m. in front of Judge Levine.
Court records show Khan pleaded guilty to misdemeanor DUI on Feb. 27, stemming from his September 2022 arrest for DUI in Lansdale Borough. Police said Khan’s blood-alcohol content in that case was .298%, however court records show he ultimately pleaded guilty to DUI: general impairment instead of DUI: highest BAC.
According to PennDOT, a first offense for general impairment carries a sentence of up to six months’ probation along with a $300 fine, attendance at alcohol highway safety school, and a drug and alcohol evaluation. There is no suspension of a driver’s license for first-time offenders of the lowest DUI charge.
