The cease-and-desist order requested by the Wawa at Sumneytown Pike and Valley Forge Road against the owner of North Penn Auto still awaits a decision as Wawa proceeds with their plan to turn the Sumney Forge Shopping Center into a “Super Wawa.”
In March, Upper Gwynedd Township’s planning and zoning officer Van Rieker told the board he issued a cease and desist order to the North Penn Auto owner at the request of the current Wawa owner, according to an article by Dan Sokil at The Reporter.
North Penn Auto, which operates its business and the Marathon gas station at the corner, then filed a lawsuit against Wawa property owner Provco Pinegood Lansdale LLC for not allowing them to park cars under repair in the parking lot after a 40-plus-year agreement, according to the article.
The decision for the cease-and-desist order has been postponed to Sept. 26 as of Tuesday night’s meeting.
Rieker first told the township commissioners in October 2022 about the proposed project at the Sumney-Forge Shopping Center, where the vacant Wawa store is located behind a Marathon gas station and garage, according to The Reporter.
Meanwhile, the zoning hearing board recently approved a sign variance package and permission for the sale of gas requested by Wawa. The board will now consider the land development plan, which was filed 12 days ago.
“I would imagine in three or four months you'll be receiving a review, resulting from the planning commission,” Rieker said.
