A Warminster man who passed out on heroin in a two-story Yorktown Village condo and left his naked 2-year-old girl unsupervised and playing in a puddle of Dawn dishwashing soap is headed to state prison for felony child endangerment, the Bucks County District Attorney announced Wednesday.
Justin Kearns, 36, who was convicted by a jury in October, was sentenced on Tuesday to 3 ½ to 7 years in state prison by Bucks County Court of Common Pleas Judge Raymond McHugh, court records show.
According to prosecutors, Warminster Township Police were dispatched at 8:23 p.m. Sept. 11, 2020 for a well-being call to the Yorktown Village neighborhood on York Road/Route 263 near North Norristown Road.
Police said a woman called 911 and reported she was at the store for an hour and when she returned, she was locked out of her apartment. She told police that her boyfriend and the girl were inside. Kearns appeared to be passed out and looked like he was not breathing, police said. The woman reported the girl was walking around the apartment.
Through a window, police saw Kearns was unresponsive and tried to wake him up by banging on the door several times, police said. When Kearns did not wake up, police broke the glass on an outside storm door and kicked in the front door, police said.
The girl was found roaming freely around the condo and had no pants or diaper on at the time, police said.
While paramedics treated Kearns, police found suspected drug paraphernalia used with heroin on the floor. The girl also appeared to have been playing in a puddle of Dawn brand dishwashing soap, police said.
Police obtained a search warrant for Kearns’ medical history and found he was treated for a heroin overdose, police said.
