Man Pleads Guilty to Striking Off-Duty Police Officer’s Vehicle with Bat During Road Rage Incident in Upper Gwynedd

A Conshohocken man has pleaded guilty to striking an off duty police officer’s vehicle with a baseball bat during a road rage incident in Upper Gwynedd Township last summer.

As part of a plea agreement with prosecutors, 38-year-old David Stitt pleaded guilty on Jan. 18 to one felony count of aggravated assault – attempts to cause bodily injury with a deadly weapon, court records show. Remaining charges of possession of an instrument of crime, simple assault, reckless endangerment, criminal mischief and harassment were dropped in exchange for his plea.

Montgomery County Common Pleas Judge Wendy Rothstein sentenced Stitt to 161 days to 23 months in county jail, followed by one year of probation, along with the stipulations that he pay restitution and avoid contact with the victim. Stitt, who was given credit for 161 days of time served since his arrest, was immediately paroled, court records show.

Upper Gwynedd Police were dispatched to the intersection of Route 202 Parkway and Welsh Road at 6:32 p.m. on Aug. 8, 2022, for a report of an armed subject. Upon arrival, police spoke with the victim — a local police officer whose name is being withheld — who stated they were traveling northbound on the parkway when the vehicle in front of them abruptly slammed on their breaks. The victim utilized their vehicle’s horn, at which point the vehicle in front of them abruptly changed lanes and ended up directly behind the victim at a stop, according to charging documents.

The driver of the other vehicle, later identified as Stitt, exited his vehicle with a baseball bat and twice struck the victim’s rear driver’s side door, police said. During the second strike, the driver’s side window shattered, causing multiple injuries to the victim’s face and left knee from flying shards of glass, police said.

Stitt then fled southbound on the parkway, according to the criminal complaint. Information from a witness corroborated the victim’s story, police said.

After being identified and contacted by police, Stitt allegedly admitted to exiting his vehicle and shattering the window with the bat, police said. Stitt, who was out on bail on multiple sets of charges across Montgomery County at the time of the incident, was officially charged on Aug. 17.

In addition to pleading guilty to the charge from the incident in Upper Gwynedd, resolved several other open cases on the same day.

Court records show that Stitt pleaded guilty to a misdemeanor hit and run charge on Jan. 18, stemming from a December 2020 incident in Conshohocken Borough, and a felony fleeing from law enforcement charge, stemming from a July 2022 incident in East Norriton Township. He was sentenced to six months’ probation on the misdemeanor charge and one year of probation on the felony charge, with both running concurrent to the other sentence.

Stitt also previously pleaded guilty to a March 2017 aggravated assault charge out of Conshohocken Borough, however sentencing information in that case is unavailable.
