Perkasie Man Strikes Plea Deal on Day of Trial, Rape and Sexual Assault Charges Dropped

A Perkasie man struck a plea deal with Bucks County prosecutors on Tuesday that saw felony rape and sexual assault charges changed to misdemeanor simple assault and reckless endangerment.

Brendan Kerr, 30, was sentenced to five years’ probation by Bucks County Common Pleas Judge Raymond McHugh after pleading guilty to misdemeanor counts of simple assault, reckless endangerment, and harassment. An additional misdemeanor charge of indecent assault without consent was dropped as part of the plea agreement, court records show.

Kerr was initially scheduled to stand trial on Oct. 4 on felony charges of rape - forcible compulsion and sexual assault, as well as misdemeanor charges of indecent assault – forcible compulsion and indecent assault without consent. However, the negotiated plea agreement saw the rape charge changed to simple assault, the sexual assault charge changed to reckless endangerment and indecent assault – forcible compulsion charge changed to harassment.

Court records show Kerr can have his probation reduced to three years so long as he satisfies the conditions of his probation, pays his fines and court costs, and has no further criminal violations.

Perkasie Borough Police were initially contacted by a female victim on June 22, 2020, who reported that she had been allegedly sexually assaulted by Kerr, whom she had known for approximately six years.

The victim said two days prior, she was helping Kerr move into a home in Perkasie then stayed at the home after staying late to help setup furniture, according to the criminal complaint. The victim said she went to bed between 2 a.m. and 3 a.m. and later awoke to Kerr being on top of her forcing her head into a pillow, the report states.

Kerr then allegedly raped the victim over a period of five to eight minutes, at which point he stopped and “almost immediately fell asleep,” police said.

The investigation continued for nearly a year, with charges being officially filed on June 15, 2021.
