Montco Man Accused of Killing Infant Son, Charged with Third-Degree Murder

A Montgomery County man has been charged with third-degree murder and related offenses in connection with the death of his 8-week-old son.

David Moyer, 24, of Trappe, was arraigned on the murder charge by District Judge Maurice Saylor, who set bail at $1 million cash. Moyer, who is also charged with endangering the welfare of a child and reckless endangerment, is in custody at the Montgomery County Correctional Facility in lieu of bail, according to court records.

Investigators said the baby had thrown up on Moyer while in his care during the morning of Feb. 22. Moyer then allegedly forcibly placed the infant face down on the bed and left him there for 20 minutes, then returned to find the baby unresponsive, according to a release from the Montgomery County District Attorney’s Office.

Instead of calling 9-1-1 for an ambulance, investigators said Moyer waited 20 minutes for an Uber to arrive to take the baby to the emergency room at Phoenixville Hospital. The release states that the infant was not breathing on arrival to the hospital, however hospital staff performed life-saving measures and were able to revive the baby, who was then airlifted to Children’s Hospital of Philadelphia (CHOP).

Staffers at CHOP contacted law enforcement due to the nature of the injuries the infant had suffered, with physicians noting both healing injuries on the infant as well as subdural hemorrhaging in the baby’s brain and numerous hemorrhages in the retina of boy’s left eye. The baby was pronounced dead at CHOP less than 10 days later, on March 3.

An autopsy performed on the infant the following day listed his cause of death as multiple blunt impact injuries and the manner of death as a homicide. Moyer was subsequently taken into custody.

Moyer’s next court appearance is a preliminary hearing on March 29 at 10 a.m. in front of District Judge Cathleen Rebar.
