Hatfield Man Arrested After Assaulting Neighbor with Pipe, Police Say

A Hatfield Township man was arrested and charged on June 27 after he allegedly assaulted his neighbor with a metal pipe.

Police were dispatched to the Rite Aid at the intersection of North Broad Street and Cowpath Road at 9:53 p.m. for a report of an assault victim. When they met with the victim, they reportedly saw swelling in the upper cheek area near both eyes. The victim had scratches to the scalp and a round-shaped scratch on their right forearm, which was bleeding, police said. 

According to the criminal complaint, the victim said the injuries were caused by their upstairs neighbor later identified as 31-year-old David Myslinski.

The victim reportedly told police they heard a banging noise coming from their window mounted air conditioning unit earlier in the evening. They went outside to see Myslinski allegedly holding a piece of pipe and saying he needed to get inside the victim’s apartment, the report states. 

Myslinksi allegedly followed the victim as they walked to a nearby business to find the landlord. After knocking and receiving no response, Myslinksi grabbed the victim’s t-shirt and told him, "Let's go back to your house,” which led to Myslinski allegedly headbutting the victim two to three times in the face and head and swinging a piece of pipe to attempt to strike them, the report states. Myslinski allegedly knocked the victim down to the ground at one point and attempted to hit them again. 

The victim told police the cut on their forearm was likely from the cut end of the piece of pipe during the struggle, according to the criminal complaint.

After the struggle, the two walked toward the residence and when they reached the Rite Aid parking lot, the victim ran inside the Rite Aid to ask employees to call 911.

Police said they believed that Myslinski under the influence of a controlled substance, as he was observed to be profusely sweating, displayed erratic behavior, and was unable to stand still. Myslinski allegedly admitted to initiating the altercation by "shoving" the victim and confirmed that he had a pipe during the altercation, according to the complaint.

The pipe used during the altercation was recovered and found to be made of metal, approximately two feet long and four inch in diameter, the report states. 

While searching Myslinski, police said they found drug paraphernalia on his person. Myslinski was then taken into custody on charges of aggravated assault, possession of an instrument of crime, simple assault, possession of drug paraphernalia and related offenses.

Myslinski was arraigned on June 28 at 8:30 a.m. by District Judge Christopher J. Cerski, who set bail at $25,000 unsecured. His next court appearance is a preliminary hearing on July 12 at 10 a.m. in front of District Judge Andrea Hudak Duffy.
