A Hatfield Township man is facing felony criminal trespassing charges after he allegedly entered a home on Orvilla Road and sat down at the homeowner’s dining table on Tuesday night.
Police were dispatched to the scene for a report of a burglary in progress at 8:36 p.m. on Oct. 19, after a female 9-1-1 caller said she and her sister had locked themselves in the bathroom after an unknown male had entered their home. Arriving officers made contact with the male — identified as 33-year-old Thomas Kelly — who was standing in the home’s rear screened0in porch with the door halfway open, according to the criminal complaint.
Police said that based on prior contacts, they were familiar with Kelly and knew that he did not reside at the home. Additionally, police on scene described Kelly as smelling of alcohol and being unsteady on his feet while walking.
One of the sisters told police that she was making food in her kitchen when she turned around and saw Kelly sitting at her dining table. The victim stated that she did not know Kelly and asked why he was in her kitchen, at which point Kelly asked “Who are you? Do you know me?” according to the complaint.
The victim then called to her sister, who went to the kitchen and stated that she did not know who Kelly was, police said. The sisters then told Kelly to leave the residence, at which point he gathered his things and moved to the screened-in porch, according to the report.
The sisters then locked themselves in the bathroom and called 9-1-1, according to the complaint. Police said Kelly was administered a portable breath test at the scene, which showed he had a blood-alcohol content of .20%.
Kelly was arraigned the following morning by District Judge Francis Bernhardt III, who set bail at $25,000 unsecured. He was then released from custody, and his next court appearance is a preliminary hearing on Nov. 30 at 10:30 a.m. in front of District Judge Andrea Duffy.
All suspects and defendants are innocent until proven guilty. This story was compiled using court records and the affidavit of probable cause.
