A Pottstown woman who was facing multiple felony weapons charges stemming from a traffic stop in Montgomery Township was sentenced to probation last week, as part of a plea agreement with prosecutors.
As part of a plea agreement with prosecutors, 35-year-old Alisha Davies entered a guilty plea on Nov. 18 to one misdemeanor count of firearm not to be carried without a license – no criminal violation. Records show that Montgomery County Common Pleas Judge Virgil Walker sentenced Davies to four years’ probation, along with the stipulation that she surrender all firearms to the district attorney’s office.
Davies was initially charged with felony counts of possession of a firearm with an altered manufacturer number, firearm not to be carried without a license and receiving stolen property, as well as misdemeanor charges of possession of a controlled substance, possession of marijuana and possession of drug paraphernalia, and summary charges of improper sun-screening and operating a vehicle with unsafe equipment. Records show that the felony firearm not to be carried without a license charge was reduced to a misdemeanor, and the marijuana charge was dropped at Davies preliminary hearing.
All other charges were dropped in exchange for Davies’ plea.
According to the criminal complaint, police were patrolling in the area of Bethlehem Pike and Knapp Road at 12:33 a.m. on June 12, 2020, when they observed a vehicle with heavily tinted windows hitting the brakes as it passed the patrol vehicle. Police then initiated a traffic stop of the vehicle along the 600 block of Bethlehem Pike, the report states.
Police made contact with the driver — identified as Davies — as well as a female in the front passenger seat and male relative of Davies in the rear seat, the report states. As police spoke to Davies, they reported smelling an odor of marijuana emanating from the vehicle and observed “indicators of deception and criminal activity,” according to the complaint.
When asked about the odor, the front seat passenger produced a half-smoked marijuana blunt, the report states. Police then removed the occupants from the vehicle and conducted a search, which revealed the following:
Davies was arraigned later that morning by Magisterial District Judge Andrea Duffy, who set bail at $10,000 cash. Court records indicate that Davies posted bond the same day, and has remained free as her case proceeded through the court system.
