Lansdale Man Charged with DUI, Child Endangerment Following Crash in Upper Gwynedd

A Lansdale man is facing charges of DUI and child endangerment in connection with a November 2020 vehicle crash that occurred while his wife and children were in the vehicle.

According to the criminal complaint, Upper Gwynedd Police were dispatched to the 100 block of State Street at 12:10 a.m. on Nov. 8, 2020, for a report of a vehicle accident. Upon arrival, police located a black Honda Pilot — driven by 44-year-old Eric Neibauer, of Lansdale — that had sustained severe front-end damage after striking an orange Jeep Wrangler that was legally parked in front of a home.

Police said Neibauer stated he was driving his wife and two children home from a friend’s residence when he struck a curb with the front passenger-side tire on South Broad Street, which caused severe damage to the tire and wheel. The report states that Neibauer then turned onto State Street and rear-ended the Jeep, causing the severe front-end damage.

When asked if he had consumed alcohol, Neibauer reportedly admitted that he had been drinking, and the report states that he was slow to recollect details about the crash and lethargic in his movements. Police then administered field sobriety tests, the results of which lead them to conclude that Neibauer was incapable of safe driving, according to the complaint.

Neibauer was taken into custody at 12:36 a.m., and he later consented to a blood draw test which was administered at 1:28 a.m., the report states. Police said the toxicology report showed that Neibauer’s blood-alcohol content was .131% at the time of testing.

Charges of DUI, reckless endangerment, endangering the welfare of children and careless driving were filed against Neibauer on Jan. 13. Court records indicate that Neibauer has a preliminary hearing scheduled for March 11 at 9 a.m. in front of Magisterial District Judge Suzan Leonard.

(All suspects and defendants are innocent until proven guilty. This story was compiled using court records and the affidavit of probable cause.)
