A Texas man is facing indecent assault charges after a female Door Dash driver said she was groped and assaulted during a delivery in Lansdale in mid-June.
On June 15, Lansdale Borough Police received a report of a possible sexual assault that occurred along the 100 block of East Main Street. Investigators spoke to the victim, who said it was her first day working for Door Dash and she was making a delivery when she was met by two males on the porch, according to the criminal complaint.
After a third male took the delivery and went back inside, both of the other males remained on the porch, where they asked the victim if she had a boyfriend and complimented her by saying she was beautiful, police said. One of the males — identified as 26-year-old Justin De Luna, of Laredo, TX — tightly grabbed the victim’s wrist and asked if he could kiss her, the report states.
De Luna allegedly attempted to force the victim to kiss him, and he also groped her backside and attempted to pull down her shirt, the report states. The victim repeatedly said “no” and attempted to resist, police said.
Eventually, the victim was able to free her arm and escape the porch, at which point the second male asked if they could request her for future deliveries, the report states. The victim then fled the scene without further incident, according to the complaint.
Two days later, investigators were able to identify De Luna as one of nearly a dozen males residing at the home where the incident took place, with all of them being employed by a local landscaping company, the report states. The victim would later positively identify De Luna out of a photo lineup, police said.
On July 10, De Luna was charged with misdemeanor counts of indecent assault without consent, indecent assault – forcible compulsion and harassment, as well as a summary charge of harassment. De Luna has not yet been arraigned on the charges, so no booking image is available and bail has not been set.
Court records indicate that De Luna has a preliminary hearing scheduled for Sept. 16 at 11:30 a.m. in front of Magisterial District Judge Ed Levine.
