Montgomery Township Man Charged With Resisting Arrest, Disarming Police Officer

A Montgomery Township man was arrested on Saturday afternoon, after he allegedly resisted arrest and disarmed a police officer who was attempting to take him into custody on a parole violation.

According to the criminal complaint, Montgomery Township Police responded to a residence within the township at 2:26 p.m. on June 15 for a domestic incident in progress. All parties were released from the scene, but when outside of the residence, police became aware that there was a warrant for the caller, identified as 43-year-old Charles Gamber.

When confronted by police about the warrant, Gamber reportedly retreated towards the front door of the residence and ignored commands to stop, at which point an officer deployed his taser to prevent Gamber from entering the home. The report indicates that the taser malfunctioned, so the officer tackled Gamber as he was opening his front door.

A scuffle on the ground ensued, with the officer drive-stunning Gamber on the back of the neck with the taser, but the report states it only had a minimal effect. As the officer attempted to drive-stun again, Gamber allegedly grabbed the taser and pulled it towards him, the report states.

The officer was able to retrieve the taser after breaking Gamber’s grip, and the struggle on the ground continued, according to the criminal complaint. As the officer was able to pin Gamber against a piece of furniture in the living room, backup arrived and police were able to take Gamber into custody.

As a result of the incident, Gamber has been charged with a felony count of disarming a law enforcement officer and a misdemeanor count of resisting arrest.

Gamber was arraigned that evening by Magisterial District Judge Karen Zucker, who set bail at $5,000 cash. He was then remanded to the Montgomery County Correctional Facility after failing to post bail. His next court appearance is a preliminary hearing on July 3 at 1:30 p.m. in front of Magisterial District Judge Andrea Duffy.

Court records indicate that Gamber was on parole after being sentenced to county jail for his third DUI in August 2018.
