A Souderton woman has been sentenced to prison, after being found guilty of charges stemming from a work-zone crash in September 2017.
Luciana Stock, 22, has been sentenced to 11½-to-23-months in prison after Judge William Carpenter found her guilty of homicide by vehicle, aggravated assault by vehicle, careless and reckless driving and recklessly endangering another person, during a non-jury trial in March. According to a report by Carl Hessler Jr. at the Pottstown Mercury, Stock will also serve five years of probation, and has been instructed to perform 100 hours of community service.
According to a release from the Montgomery County District Attorney’s Office, the incident occurred at 2:27 p.m. on Sept. 5, 2017, when Franconia Township Police responded to a vehicle crash on West Broad Street in Souderton. Stock was driving westbound through a work zone when she drove over a cone and struck two workers, identified as 53-year-old David Smith and 46-year-old Jeffrey Moyer.
Smith—a graduate with North Penn High School’s Class of 1982—was taken to Grandview Hospital, where he was pronounced dead. Moyer, who suffered serious injuries, was airlifted to Temple University Hospital in Philadelphia.
The release states that the work zone was clearly marked with cones and flashing lights, and investigators concluded that Stock was traveling at 39-miles-per-hour in a 35-mile-per-hour zone. Detectives found no evidence that Stock was using her cellphone at the time of the crash, but she later told investigators that she had taken her eyes off the road while reaching for her cigarettes.
“I looked up and there were two people on my windshield,” said Stock, in her statement to detectives. “I tried to brake but it was too late.”
As a result of the sentence, Stock will be under court supervision for a period of seven years. Reports indicate that she will be eligible for work release while incarcerated at the Montgomery County Correctional Facility.
