A Lansdale man is facing felony criminal trespassing charges after he allegedly entered an elderly woman’s home, took his shirt off and lay in her bed on Thanksgiving evening.
According to the criminal complaint, police were dispatched to a home in Lansdale Borough at 8:20 p.m. on Nov. 28 for a report of an intoxicated intruder who was refusing to leave. Upon arrival, police met the homeowner—an 83-year-old woman who lives alone—who stated that an intoxicated male was currently on the rear deck outside of her bedroom, the report states.
The woman told police that she had been on her computer most of the evening, and hadn’t noticed anything out of the ordinary. The woman said she then went to her bedroom at approximately 8:10 p.m., and found a Hispanic male—later identified as 33-year-old Edvin Osorio-Ruiz—allegedly lying shirtless in her bed, according to the complaint.
The report states that Osorio-Ruiz allegedly gained access to the home via an unlocked sliding door.
The woman stated that Osorio-Ruiz appeared to be heavily intoxicated, and when she asked him to leave, he allegedly refused, the report states. She then called 911, and a short time later, Osorio-Ruiz allegedly got out of the bed and walked onto the rear deck, according to the complaint.
Police entered the home and located Osorio-Ruiz standing shirtless on the rear deck, the report states. Osorio-Ruiz was allegedly swaying back and forth, and when police stepped onto the deck, they noted a strong odor of alcohol emanating from his person, according to the complaint.
After a brief struggle, Osorio-Ruiz was taken into custody, the report states. He was then transported to the Lansdale Borough Police Station, where a portable breath test allegedly showed that he had a blood-alcohol content of .213-percent, according to the complaint.
Police said that due to a language barrier and Osorio-Ruiz’s level of intoxication, they were unable to secure any pertinent facts that would explain why he was in the home.
As a result of the incident, Osorio-Ruiz has been charged with one felony count of criminal trespassing, along with a summary charge of public drunkenness.
Osorio-Ruiz was arraigned Nov. 29 by Magisterial District Judge Katherine McGill, who set bail at $10,000 unsecured. He was then released from custody, and his next court appearance is a preliminary hearing on Jan. 8, 2020, at 2:15 p.m. in front of Magisterial District Judge Ed Levine.
