A Souderton man is facing a felony charge after attempting to purchase a firearm in Montgomery Township.
According to police, Christopher Burgert, 46. was attempting to purchase a .22 caliber rifle on July 24 from Dick’s Sporting Goods. While filling out the required Alcohol Tobacco and Firearms Form 4473, Burgert checked “no” under the question “Have you ever been convicted in any court of a felony, or any other crime for which the judge could have imprisoned you for more than one year, even if you received a shorter sentence including probation?”
The police report states that after submitting the form for the background check through the Pennsylvania Instant Check System, it was discovered that Burgert had been convicted on a misdemeanor charge of making terroristic threats in 1991, which prohibits him from owning or purchasing a firearm. The Pennsylvania State Police Firearms Division then notified Montgomery Township Police Department, who made the arrest a short time later on a felony charge of making a false statement and a misdemeanor charge of "statement under penalty."
Burgert was arraigned by Magisterial District Judge Andrea Duffy on Sept. 10, who set bail at $10,000 unsecured. His next court appearance is a preliminary hearing scheduled for Sept. 20 at 11:45 a.m. in front of Judge Duffy.
